Family asked to pay for car damage after dog run over
I can't believe how stupid some people are, letting their dogs roam on the road. If I ever hit someones dog on the road they better look out! I love dogs too much to be put in the position of posibly killing one because they did not want to fence. The last thing they would should be worried about is paying to fix my car.....sheesh The poor dog!!!

State Farm Insurance has asked a Canadian family to pay for repairing a bro...
A car insurer has asked a Canadian family to pay for repairing a broken bumper after their dog was struck by the vehicle and died, local media said Thursday.
The traffic accident occurred in March while Jake, a 12-year-old yellow Labrador, was out for his daily stroll around a quiet neighborhood in Aurora, Ontario, north of Toronto.
Kim Flemming had let the dog out when she arrived home from work. Moments later, a man knocked on the door to say a car had run over Jake.
"I got to the road and he was dying," Flemming told the Toronto Star. "He died in my arms."
Two months later, the family received a bill in the mail for 1,732.80 Canadian dollars (1,648.95 US) from State Farm Insurance.
The letter said Flemming had been found responsible for damage to the vehicle. "As such, we are looking to you for reimbursement," it reportedly stated.
State Farm spokesman John Bordignon told the Star: "They could have made sure their dog wasn't free on the roadway."
A local bylaw requires pets to be on a leash when off the owner's property, but the Flemmings said Jake had become accustomed to roaming outside the family's home.
State Farm was not immediately available for further comment.
"We've lost a member of our family but we're supposed to pay for the damage to her bumper? That's just wrong," daughter Katherine Flemming said.

Seriously??? This is crazy! Pay for the car damage??? WOW! Unbelieveable how low people will stoop for a few bucks these days...

I guess we are coming from different points of views on this one Todd. I think the woman that opened the door for the dog and released it to it's painfull death should be charged with criminal neglagence and animal cruilty. What if instead of hiting the dog, the driver vered into head on traffic? How irresponsible, what control did she have of her dog. She gives dog owners a bad name. I hope she is made to pay trippel damages but I think that is an American consept. In my books this was not an accident!

more and more insurance companies are going after pet owners if there pet was not leashed and somehow causes an accident.. They dont want to pay for repairs if they dont have too.

Don't get me wrong. I think the woman who let the dog out should be in trouble as well. I'm just saying I also think it is bull that the woman that hit the dog is trying to get paid for the damage. As if she is more worried about getting her cash than the well being of the dog she hit in the first place...

Oh OK, then you don't know the insurance system in Ontario, it is called 'no fault' insurance. So regardless of who is at fault, you sue or claim against your own insurance company/policy. Also, it is illegal not to report an accident/claim with damages over $1,000. If you claim or not, drivers rate will now go up, driver might as well claim damage as most likely ihis rate is going up and he has $1700+ in damages. It is the insurance company that is going after dog owner, not the driver. They wan't money from the driver, higher premiums and the dog owner will pay or they sue. So it is a win win for the insurance company.

Wow, sad story.
The one who really lost here was the dog.
If I smashed up my car because some idiot had no control over their animal I would be mad. Mad that the dog was killed and that the owner was a jerk. And what about my car?
And from what I read it was the insurance company asking for the money not the driver.

This makes me sick!!!! How dare the insurance comp...All though surprised I'm not!..In 01 my late husband was T-boned and killed by someone who was doing 85 in a 55 and the insurance comp had the nerve to try and sue me for damages...LOl...That for sure didn't happen they paid me...When their agent came to my house within a few days of my husbands death I told her to call my lawyer and get the hell out before I inflicted bodily injury on her!!!!
Insurance companys make me so sick with their greed and the way they'll do whatever they can not to pay out...Ugggh!

State Farm Insurance your good neighbour my ass. They only care about the dollar signs and don't care who they hurt. I was with State Farm for a few years, they had no problem withdrawn my money but when I got into an accident they refuse to pay for the accident. State Farm Insurance can never be trusted!!

No leash law in that town? The dog's owner should have had her dog fenced or on a leash, not running loose in the road. Sorry, jmo.

It depends on weather the dog was allowed to rome or escaped out the fense or front door or something.

About a year ago I was walking Gracie in our neighborhood and her and a 'loose' dog started growling and barking at one another and Gracie actually pulled out of her harness. I was terrified and grabbed her into my arms and carried her tightly to our home a few blocks away... I almost lost her that day... that same dog is left loose outside of it's home often. I've actually been walking Gracie and started down that road just to see the woman 'owner' standing on her porch and talking on the phone while waving for me to "go in another direction..." because her dogs are running loose in her yard.
I can understand if a dog is loose by accident... but to give them the freedom to run .... I just don't get it.
In this situation, I agree w/ you Todd in a way. I wouldn't want money after hitting someone's dog. I'd be devastated. On the other hand... maybe it will teach the owner a lesson... who knows?!
When I want to give Gracie good excersize we go to the tennis courts and lock the gates and there we play till she's pooped.

I think the article said the owner had "let her dog out" when she got home from work. For his daily stroll. Seems to me, again just my opinion, but it seems to me that if you are a responsible owner, you don't let your dog out on the street unleashed. Daily.
